Terms of Service

1. About these Terms

These Terms of Service ("Terms") form a binding electronic contract between you ("you", "Customer") and Eat Fresh Jo ("we", "us"), operating in the Hashemite Kingdom of Jordan. By creating an account, browsing, or placing an order through our website or mobile application (the "Platform"), you confirm that you have read, understood and accepted these Terms in full.

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, including without limitation the Electronic Transactions Law No. 15 of 2015, the Consumer Protection Law No. 7 of 2017, the Personal Data Protection Law No. 24 of 2023 and the Jordanian Civil Code No. 43 of 1976.

2. Eligibility

You must be at least eighteen (18) years old and have full legal capacity under Jordanian law to use the Platform and place orders. By using the Platform you warrant that the information you provide is true, accurate and current, and that you are ordering for personal, non-commercial use unless otherwise agreed in writing.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate any account at our discretion where we reasonably believe it has been used in breach of these Terms or applicable law.

4. Orders and Contract Formation

Each order you submit is an offer to purchase. A binding contract is formed only when we issue an order confirmation. We may refuse, cancel or limit any order — including after confirmation — in cases of pricing or description errors, stock unavailability, suspected fraud or breach of these Terms. Where we cancel a paid order, the amount paid will be refunded to the original payment method or, at the customer's option, as loyalty points of equivalent value.

5. Pricing, Taxes and Payment

All prices are quoted in Jordanian Dinar (JOD) and include applicable taxes (including General Sales Tax) unless stated otherwise. Delivery fees, where applicable, are shown before order confirmation. We accept Cash on Delivery (COD) and CliQ. Where payment via CliQ cannot be validated, the order will not be processed.

Prices, promotions and product availability may change at any time without prior notice and apply only to orders placed after the change.

6. Delivery

We deliver only within service zones we designate inside Jordan. Delivery time windows are estimates and may be affected by traffic, weather, force majeure or operational constraints. You are responsible for providing an accurate, accessible address and a valid contact number, and for being available to receive the order. If delivery fails due to your absence or incorrect information, additional delivery fees may apply, and perishable items may be discarded without refund.

7. Inspection on Receipt

You must inspect the order upon delivery and report any visible damage, missing items or quality issues within twenty-four (24) hours of receipt through the in-app "Report an issue" flow, in accordance with our Refund Policy. Failure to do so within this window will be deemed acceptance of the order as delivered.

8. Loyalty Points

Loyalty points are a promotional benefit, not legal tender. They have no cash value, cannot be sold, transferred or exchanged outside the Platform, and may be expired, adjusted, suspended or cancelled at our discretion in line with the loyalty program rules in force from time to time. Points obtained through fraud, abuse or error may be reversed without notice.

9. Product Information & Substitutions

We make reasonable efforts to ensure accurate product descriptions, images, weights and prices, but we do not warrant that the content is error-free. Natural produce varies in size, color and weight; minor variations are not defects. Where a specific item is unavailable, we may, with your consent or where reasonable, substitute it with a comparable product of equal or greater value.

10. Allergens and Health

Information on ingredients and allergens is provided for guidance only. We cannot guarantee that any product is free from cross-contamination. You are responsible for checking product details before consumption. The Platform does not provide medical or dietary advice; consult a qualified professional for any health concern.

11. Acceptable Use

You agree not to:

• use the Platform for any unlawful, fraudulent or harmful purpose;
• resell, redistribute or commercially exploit any product purchased without our written consent;
• upload false reports, manipulated images or misleading content;
• attempt to bypass security, scrape data, reverse-engineer or interfere with the Platform;
• infringe any intellectual property, privacy or other right of any party.

Violations may result in account suspension, cancellation of orders and points, and referral to the competent Jordanian authorities.

12. Intellectual Property

All trademarks, logos, content, software and design on the Platform are owned by or licensed to Eat Fresh Jo and are protected under Jordanian and international intellectual property laws. No right or licence is granted to you other than the limited, non-exclusive, non-transferable right to use the Platform for its intended purpose.

13. User Content

By submitting any content (including photos uploaded with refund or issue reports, reviews or messages), you grant us a non-exclusive, royalty-free, worldwide licence to use, store, reproduce and process that content for the purposes of operating, improving and protecting the Platform, and to comply with legal obligations. You warrant that you have the right to submit such content and that it does not infringe any third-party rights or applicable law.

14. Disclaimer of Warranties

To the maximum extent permitted by Jordanian law, the Platform and the products are provided "as is" and "as available". We disclaim all warranties not expressly granted herein, including implied warranties of merchantability, fitness for a particular purpose, uninterrupted availability and non-infringement. Statutory rights granted to consumers under the Consumer Protection Law No. 7 of 2017 remain unaffected.

15. Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability to you arising out of or in connection with any order, the Platform or these Terms shall not exceed the amount actually paid by you for the specific order giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential or punitive damages, loss of profit, loss of data, loss of opportunity, or moral damages, whether based on contract, tort or otherwise, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Jordanian law (including for fraud or gross negligence).

16. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, pandemics, government action, supply-chain disruption, network or utility failures, or extreme weather conditions.

17. Indemnity

You agree to indemnify, defend and hold harmless Eat Fresh Jo, its affiliates, owners, employees and agents from and against any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Platform, or violation of any applicable law or third-party right.

18. Privacy

We process personal data in accordance with our Privacy Policy and the Personal Data Protection Law No. 24 of 2023 of Jordan.

19. Changes to the Terms

We may modify these Terms at any time by publishing an updated version on the Platform. Material changes will be brought to your attention. Continued use of the Platform after the changes take effect constitutes acceptance of the revised Terms.

20. Suspension and Termination

We may suspend, restrict or terminate your access to the Platform at any time, with or without notice, where we reasonably believe you have breached these Terms, abused the loyalty program, engaged in fraudulent activity or where required by law.

21. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right shall not constitute a waiver of that right.

22. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan. The competent courts of Amman shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, without prejudice to any mandatory consumer protection rights to file complaints before the relevant Jordanian regulatory authorities.
